The Health Insurance Portability and Accountability Act of 1996 (HIPAA) is a federal law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient’s consent or knowledge.
Information Blocking - 21st Century Cures Act (more information HERE)
The 21st Century Cures Act (Cures Act) was signed into law on Dec. 13, 2016 with the final rule by the ONC in 2020. Information Blocking refers to the deliberate interference with the sharing or use of electronic health information. This interference can occur through practices or technical measures that limit access, exchange, or use of health information. The aim of the ONC's Information Blocking rule is to promote interoperability and facilitate the secure and seamless exchange of health information. So basically, the rule provides the opportunity for patients to have access to their healthcare records “without delay” as defined by the ONC. The key goals for this rule are to 1) increase patient engagement in care, 2) increase safety, and 3) decrease healthcare costs.
